My Adventure Campers CamperVan Terms and Conditions – May 2022 In the event of any discrepancy between these Terms and Conditions and any other ‘My Adventure Campers’ literature and/or their website, the provisions of these Terms and Conditions apply. ‘BOOKING’ refers to the booking made by the HIRER and accepted by MAC, in order to secure the hire of the CAMPERVAN vehicle between the date and time of collection and the date and time of return. ‘CAMPERVAN’ refers to the CamperVan vehicle under hire as described under the heading ‘Vehicle Details’ under the ‘RENTAL AGREEMENT’ and includes tyres, tools, accessories, living equipment and any other special equipment and documents relating to the use and operation of the CAMPERVAN vehicle under the HIRER’S use and control, as provided by MAC. ‘DEPOSIT FEE’ refers to the sum of twenty-five (25) per cent of the RENTAL CHARGE that is payable by the HIRER, in order for the BOOKING to be made. ‘DRIVER’ refers to any driver authorised to drive the CAMPERVAN vehicle and where insurance cover has been provided by MAC’s insurer. ‘EXTRA EQUIPMENT’ refers to the extra equipment requested to be supplied to the HIRER at the time of the BOOKING, equipment that is not included in the CAMPERVAN vehicle standard equipment. ‘HIRE PERIOD’ refers to the dates as set out in the BOOKING and RENTAL AGREEMENT, confirming the dates and times of collection and return of the CAMPERVAN vehicle. ‘HIRER’ refers to the person nominated as the hirer under the RENTAL AGREEMENT. ‘INSURANCE LOADING CHARGES’ refer to any additional insurance charges are levied by MAC’s insurers for additional insurance risks posed by any proposed DRIVER. ‘MAC’ refers to My Adventure Campers Limited, Shore House, Shore Farm, Shore Farm Way, off Knowsley Road, Ramsgreave BB1 9QA. ‘RENTAL AGREEMENT’ refers to the rental agreement document between the HIRER and MAC covering the HIRER’S rental and use of the CAMPERVAN vehicle. The RENTAL AGREEMENT includes details of ‘HIRER’, ‘CAMPERVAN Vehicle Details’, ‘Rental Period’, ‘Pre-Hire Checklist’ and ‘Post-Hire Checklist’. ‘RENTAL BALANCE FEE’ refers to the difference between the RENTAL CHARGE and the DEPOSIT FEE, which is due six (6) weeks prior to the date and time of the CAMPERVAN vehicle collection. ‘RENTAL CHARGE(S)’ refers to the total rental charge for the CAMPERVAN, including any EXTRA EQUIPMENT ordered by the HIRER, any INSURANCE LOADING CHARGES. The RENTAL CHARGE will be confirmed in the BOOKING and the RENTAL AGREEMENT. ‘REPLACEMENT VEHICLE’ refers to any replacement vehicle which MAC may offer to the HIRER as an alternative to the allotted CAMPERVAN vehicle as set out in the BOOKING and RENTAL AGREEMENT. ‘SECURITY DEPOSIT’ refers to the security deposit of £2,000.00 that is required as a pre-authorised transaction on the HIRER’S credit or debit card, at the date and time of the CAMPERVAN vehicle collection. ‘STANDARD INSURANCE EXCESS’ refers to the £1,000.00 standard insurance excess that applies to all insurance claims, which the HIRER is responsible for. ‘UK’ refers to the geographical limits of the United Kingdom of Great Britain and Northern Ireland, the Isle of Man and the Channel Islands. ________________________________________ 1. RESERVATIONS AND PAYMENTS ________________________________________ • all prices as quoted and charged in £ (GBP). • MAC accept credit and debit cards, or alternatively bank transfer. • the RENTAL CHARGE (unless increased due to additional INSURANCE LOADING CHARGES at the date and time of the CAMPERVAN vehicle collection) will be confirmed by MAC at the time of the BOOKING. • the DEPOSIT FEE is required to be paid by the HIRER in order to confirm the BOOKING. • the RENTAL BALANCE FEE is required to be paid by the HIRER six (6) weeks prior to the date and time of the CAMPERVAN vehicle collection. • where at the date and time of the CAMPERVAN vehicle collection, additional INSURANCE LOADING CHARGES are confirmed as due (this may apply as an example where the additional / changed DRIVER’S are included and/or the insurance eligibility circumstances of any DRIVER has changed from the date of the BOOKING and at the date / time of the collection). • the CAMPERVAN vehicle will not be released to the HIRER without the SECURITY DEPOSIT transaction being completed and the ‘Pre-Hire Checklist’ being agreed between the HIRER and MAC. ________________________________________ 2. RENTAL HIRE PERIODS ________________________________________ • rental hire of the CAMPERVAN vehicle is charged on a per day basis; • rental hire of EXTRA EQUIPMENT is charged on the either a per day or HIRE PERIOD basis as set out on the website. • minimum rental HIRE PERIOD is two (2) days (except that where a public holiday in England occurs on an adjacent day to the proposed rental hire dates, the minimum rental HIRE PERIOD is extended to include those public holiday dates); • collection and return is available on a seven (7) days per week basis, excluding Christmas Day or Boxing Day; • collection times are strictly between 1500-1700 hours; • return times are strictly between 1000-1200 hours; any returns after 1200 hours are charged at £50.00 per part or full hour that has elapsed after 1200 hours on the allotted return date; • any late returns must be advised by telephone to MAC immediately and in any event, prior to 0900 hours on the date and time of return. ________________________________________ 3. HIRE RATES INCLUDE ________________________________________ • all applicable taxes and levies; • unlimited mileage; • fully comprehensive insurance for one (1) named DRIVER; * • full RAC breakdown and roadside assistance cover within the UK; ** • full kitchen kit, including utensils, plates, bowls, mugs, tumblers and pans, plus a ‘welcome pack’ of milk, tea, coffee and sugar; • a full list of the standard equipment that is included with the CAMPERVAN vehicle can be found on our website; * excluding any INSURANCE LOADING CHARGES, extra charges may be incurred inter alia if any proposed DRIVER has a traffic conviction, been disqualified, holds a driving licence from a non-EU country and/or is in an occupation which is deemed by MAC’s insurer to be high-risk. ** full RAC breakdown and roadside assistance will be provided to cover any mechanical faults to the base chassis of the CAMPERVAN vehicle, within the geographic limits of the United Kingdom and Northern Ireland, the Isle of Man and the Channel Islands. Any call out and repair charges necessitated by the HIRER through operator error (e. g. mis-fueling, a flat vehicle battery etc.) and that may get charged to MAC, will be the responsibility of the HIRER and payable by the HIRER to MAC. ________________________________________ 4. HIRER AGE AND DRIVING LICENCE CREDENTIALS ________________________________________ The HIRER must accept the following age and licence credentials: 4(A). DRIVER AGE LIMITS Aged between 23 and 75. 4(B). DRIVING LICENCE DOCUMENTATION • DRIVER(S) must hold a valid full driving licence for at least 24 months; • all DRIVER(S) must be present for collection of the CAMPERVAN vehicle, due to rules set by MAC’s insurer’s. No whatsoever exceptions can be made; • DRIVER(S) must provide two (2) separate forms of identification in the form of valid passport and photocard driving licence, both at the time of the BOOKING and also at the date and time of collection of the CAMPERVAN vehicle, otherwise the proposed DRIVER will not be insured and will unfortunately be prohibited from driving the CAMPERVAN vehicle; • if any proposed DRIVER has a Great Britain issued driving licence, MAC require the proposed DRIVER to share a valid DVLA driving licence check code obtained from the DVLA website, both at the time of BOOKING and also at the date and time of collection of the CAMPERVAN vehicle; • if any proposed DRIVER has a Northern Ireland issued driving licence, MAC in addition require the proposed DRIVER to provide both the photocard driving licence and the driving licence paper counterpart; • INSURANCE LOADING CHARGES may apply for DRIVER(S) who hold driving licence penalty points; • MAC cannot accept any proposed DRIVER(S) who: • have more than two (2) convictions with a maximum of three (3) driving licence penalty points per conviction; • had obtained a BA, DD or UT category conviction; • have had their driving licence suspended for any period within the last three (3) years; • has been involved in more than one (1) fault incident within the last (3) years; • if any proposed DRIVER has any endorsements on their driving licence, this must be declared to MAC both at the time of the BOOKING and also at the date and time of collection of the CAMPERVAN vehicle; MAC may not be able to provide insurance cover for some endorsements; • if any proposed DRIVER has had any accidents or claims made against them in the last three (3) years, this must be declared to MAC both at the time of the BOOKING and also at the date and time of collection of the CAMPERVAN vehicle; MAC may not be able to provide insurance in these circumstances or INSURANCE LOADING CHARGES may apply; • any proposed DRIVER(S) holding only an automatic driving licence, are NOT permitted to drive any of our CAMPERVAN vehicles; • where any proposed DRIVER has any of the following occupations they must be declared (celebrities / sports personalities / musicians / entertainers / serving foreign armed services personnel / UK based embassy employees / students under the age of thirty (30), this must be declared to MAC both at the time of the BOOKING and also at the date and time of collection of the CAMPERVAN vehicle; MAC may not be able to provide insurance in these circumstances or INSURANCE LOADING CHARGES may apply; • should any proposed DRIVER fail to present all of the correct driving licence documentation on collection of the CAMPERVAN vehicle or the driving licence documentation does not meet the requirements as set out above or as stipulated by MAC’s insurer’s, then such proposed DRIVER(S) will not be provided with insurance cover and will not be allowed to drive the CAMPERVAN vehicle; • where all proposed DRIVER(S) fall into the above category, MAC will not release for hire the CAMPERVAN vehicle, and no refunds for any RENTAL CHARGES paid by the HIRER will be given; • any failure to declare endorsements, driving convictions, accidents or claims shall invalidate insurance cover for the CAMPERVAN vehicle. ________________________________________ 5. INSURANCE ________________________________________ Fully comprehensive insurance is provided by MAC through our insurers for the CAMPERVAN vehicle being driven by the DRIVER(S) named in the RENTAL AGREEMENT. The CAMPERVAN vehicle is insured for damage to the CAMPERVAN and the property of a third party but does not include any personal insurance for the HIRER (or his/her party) including death or bodily injury to any DRIVER nor does it cover any personal possessions of the HIRER (or his/her party). Where the HIRER declares that he proposes to tow a trailer for the purposes as permitted within these Terms and Conditions, then where only third-party insurance coverage applies). The BOOKING and the RENTAL AGREEMENT sets out whether any towing of a trailer is permitted. 6. ADDITIONAL INSURANCE CHARGES The standard hire rate for the CAMPERVAN vehicle only covers one (1) DRIVER. Insurance cover for any additional proposed DRIVER(S) is charged additionally on a per day basis for the full duration of the HIRE PERIOD. 7. INSURANCE LOADING CHARGES INSURANCE LOADING CHARGES may apply under the following circumstances, where insurance cover can be provided by MAC’s insurer’s, for any proposed DRIVER who: • has any endorsements on their driving licence; • has been convicted of a driving offence; • holds driving licence penalty points; • has had any accidents or claims made against them in the last three (3) years; • has an occupation that is deemed by MAC’s insurer’s to be a high-risk occupation (refer to Section 4(B)); • holds a non-UK or EU driving licence; and • has declared within the BOOKING and the RENTAL AGREEMENT, the use of the CAMPERVAN vehicle to tow a trailer as permitted by these Terms and Conditions. 8. INSURANCE COVER EXCLUSIONS The fully comprehensive insurance cover provided as standard with the CAMPERVAN vehicle, excludes the following events: • theft of the CAMPERVAN vehicle where the vehicle keys are left in or on the vehicle, or in an unsecure place whilst the vehicle is unoccupied (the HIRER shall be held fully responsible for the cost of a replacement vehicle); • overhead damage to the CAMPERVAN vehicle (including damage to the raised hood) and any such similar damage is deemed as gross negligence (the HIRER accepts full liability for these damages which are chargeable in addition to the STANDARD INSURANCE EXCESS of the CAMPERVAN vehicle); • underside/body damage to the CAMPERVAN vehicle (the HIRER accepts full liability for these damages and agrees to pay a fixed charge of £2,500.00, which is in addition to and not covered by the SECURITY DEPOSIT); • contamination of the CAMPERVAN vehicle fuel tank (i.e. by putting in the wrong fuel); • contamination to any on-board water tank (i.e. by putting in fuel). ________________________________________ 9. SECURITY DEPOSIT ________________________________________ 1) the SECURITY DEPOSIT must be taken before the hire of a CAMPERVAN vehicle commences; 2) The SECURITY DEPOSIT must be on either credit or debit card, and debited in £ (GBP); 3) MAC reserve the right to charge an increased SECURITY DEPOSIT to a HIRER, either because of the proposed DRIVER(S), where the CAMPERVAN vehicle is being used at a high-risk event (e.g. music festival) or due to additional risks to the CAMPERVAN vehicle arising from inclement and seasonal weather conditions during the dates of the HIRE PERIOD. For all CAMPERVAN vehicle hires under ten (10) days, a pre-authorisation of the SECURITY DEPOSIT will be taken by MAC seven (7) days before the date of collection. For all CAMPERVAN vehicle hires above ten (10) days, the SECURITY DEPOSIT will be debited at the time of collection and refunded upon the return of the CAMPERVAN vehicle, subject to the CAMPERVAN vehicle being returned to MAC to the required satisfactory standard. Refunds (in full or in part) will be processed by MAC within two (2) days of the date of return of the CAMPERVAN vehicle, provided there are no insurance claims, accidents, incidents, damages and/or any other outstanding matters arising which prevent any release of a refund of the SECURITY DEPOSIT (these are set out below for reference), at the date and time of return of the CAMPERVAN vehicle. In the event of an accident involving the CAMPERVAN vehicle, the HIRE PERIOD will immediately cease and MAC will not be responsible for providing a replacement vehicle to the HIRER nor will MAC issue a refund for the remaining period of the HIRE PERIOD. In the event of an insurance claim/incident, then regardless of fault, the SECURITY DEPOSIT will be retained by MAC until their insurers have settled the claim (note this can be a lengthy process and is completely out of the control of MAC). Where MAC are unable to issue a full or part refund of the SECURITY DEPOSIT for the reasons set out above, MAC will notify the HIRER within seven (7) days of the date and time of the return of the estimate of the likely costs and damages that the HIRER is responsible. HIRER irrevocably authorises MAC to deduct from the SECURITY DEPOSIT (and/or the credit/debit card provided) any amounts due to MAC arising out of any liability or breach of the HIRER to these Terms and Conditions, and the RENTAL AGREEMENT. HIRER agrees to pay MAC within twenty-eight (28) days of the earliest date of either the date of return or the end of the HIRE PERIOD, any additional costs due to MAC over and above the value of the SECURITY DEPOSIT should costs, losses and damages exceed the SECURITY DEPOSIT. The SECURITY DEPOSIT will be used by MAC for reimbursement of the following: • any late CAMPERVAN vehicle return charges; • any costs (as charged to MAC) associated with the call-out and rectifying any defect to the base chassis of the CAMPERVAN vehicle which is deemed to be HIRER or DRIVER error / fault, where such costs may be charged to MAC (examples include works to remedy the incorrect re-fuelling of the CAMPERVAN vehicle and a flat battery etc.); • to cover all applicable insurance excesses in the event of any incident, accident or damage; • damage to the windscreen, windows, wing mirrors, fitted external accessories (including any tow bar where fitted), tyres (including the spare tyre) and/or alloy wheels (but excluding damage to the raised hood, which is treated as overhead damage); • damage to any EXTRA EQUIPMENT; • damage to the CAMPERVAN vehicle standard equipment, fixtures and fittings; • damage caused by negligent use or operation of the CAMPERVAN vehicle; • cleaning fees of £150.00, where the CAMPERVAN vehicle is brought back with the interior not in a clean condition and/or where smoking in the CAMPERVAN vehicle is detected and/or not in the same condition as at the date and time of collection; • a fee of £50.00, where any supplied chemical toilet and/or water waste tanks are not emptied at the date and time of return of the CAMPERVAN vehicle; • costs and fees in administering insurance claim, incidents, accidents, road traffic and other violations and fines (penalty charge notices, parking and speeding fines or other fines). The SECURITY DEPOSIT will not be used to reimburse MAC for any of the following matters, and the HIRER will be fully responsible to MAC for these costs and damages: • theft of the CAMPERVAN vehicle where the vehicle keys are left in or on the vehicle, or in an unsecure place whilst the vehicle is unoccupied (the HIRER shall also be held fully responsible for the cost of a replacement vehicle); • overhead damage to the CAMPERVAN vehicle and any such damage is deemed as gross negligence (the HIRER accepts full liability for these damages which are chargeable in addition to the STANDARD INSURANCE EXCESS of the CAMPERVAN vehicle); • underside/body damage to the CAMPERVAN vehicle (the HIRER accepts full liability for these damages and agrees to pay a fixed charge of £2,500.00 in addition to the SECURITY DEPOSIT); • costs to put right any contamination of the CAMPERVAN vehicle fuel tank (i.e. by putting in the wrong fuel); • costs to put right any contamination to any on-board water tank (i.e. by putting in fuel). Noting that it often takes longer than twenty-eight (28) days for any notices in respect of road traffic and other violations and fines (penalty charge notices, parking and speeding fines or other fines) to reach MAC, the HIRER agrees to pay any resultant charges and fees, and MAC’s administrative costs, within fourteen (14) days of MAC’s request for reimbursement. 10. EXTRA EQUIPMENT THAT CAN BE HIRED ________________________________________ The following EXTRA EQUIPMENT can be requested by the HIRER and included in the BOOKING and the RENTAL AGREEMENT, subject to availability and at the costs as detailed in our website: • bedding (duvet, pillows and covers) • towel pack; • dog-pack; • fold-up outdoor table and 2 chairs; • portable toilet (c/w toilet tent, chemicals and degradable toilet paper). Ordering and payment for EXTRA EQUIPMENT are payable by the HIRER at time of the BOOKING, in order to secure the availability of the EXTRA EQUIPMENT. ________________________________________ 11. DIESEL FUEL & GAS CANISTER LEVELS ________________________________________ The CAMPERVAN vehicle will be supplied with a full tank of diesel at the date and time of collection. At the date and time of the return, the CAMPERVAN vehicle needs to be returned with a full tank of diesel. Where the CAMPERVAN vehicle is not returned with a full tank of diesel, the HIRER will be charged for the missing diesel fuel that MAC have had to provide at the rate per litre as set out in the BOOKING and the RENTAL AGREEMENT; this charge will be recovered by MAC from the SECURITY DEPOSIT. The CAMPERVAN vehicle will be supplied with one (1) gas canister to run the on-board fridge, cooking hob and on-board night heater. The gas canister may not be full (and will only have what was remaining from the previous hire) but should be sufficient for the HIRER’s needs during the HIRE PERIOD. Replacement gas canisters can be purchased from garages and recognised outlets, and the HIRER is requested to retain and show the payment receipt for any replacement gas cylinder purchased and MAC will reimburse the cost incurred at the date and time of return. 12. CAMPERVAN COLLECTION AND RETURN Our depot is open between the hours of 1000 and 1200 hours, and 1500 and 1700 hours, on a seven (7) days per week basis, excluding Christmas Day or Boxing Day. The dates and times of collection and return of the CAMPERVAN will be confirmed in the BOOKING and in the RENTAL AGREEMENT, but for reference are as follows: The CAMPERVAN vehicle collection time is strictly between 1500-1700 hours. At the date and time of collection, HIRER’s should allow one (1) hour to complete all insurance documentation checks, the ‘Pre-Handover Checklist’ and demonstration of use and operation of the CAMPERVAN vehicle. Any possibility or prospect of a late collection of the CAMPERVAN vehicle by the HIRER must be advised to MAC by telephone prior to 1300 hours on the day of collection. Any late arrival for collection of the CAMPERVAN vehicle by up to one (1) hour will incur a charge of £50.00, which will need to be paid by the HIRER prior to release of the CAMPERVAN vehicle. Any late arrival of the HIRER to collect the CAMPERVAN vehicle beyond 1800 hours on the planned date of collection, will result in the CAMPERVAN collection being delayed to the following day and between 1000 and 1200 hours. No refunds will be provided by MAC for this delayed collection by the HIRER. The CAMPERVAN vehicle return time is strictly between 1000-1200 hours. At the date and time of return, HIRER’s should allow one (1) hour to complete all insurance documentation checks, the ‘Post-Handover Checklist’ and payment transaction for the return of any residual SECURITY DEPOSIT monies due back. The CAMPERVAN vehicle must be returned fully-fuelled, any supplied portable toilet cassette empty, a clean interior and with the CAMPERVAN and any EXTRA EQUIPMENT undamaged and in the same condition as on collection. Any possibility or prospect of a late return of the CAMPERVAN vehicle by the HIRER must be advised to MAC by telephone immediately and in any event, prior to 0900 hours on the allotted date and time of return. The HIRER will be charged £50.00 per part or full hour elapsed after the 1200 hours on the allotted date of return. This charge will be deducted from the SECURITY DEPOSIT. ________________________________________ 13. CANCELLATION OF BOOKING OR TERMINATION OF HIRE BY MAC ________________________________________ MAC will make every effort to have the CAMPERVAN ready for collection at the date and time confirmed in the BOOKING and the RENTAL AGREEMENT. However, during busy periods there may be time delays which are outside of MAC’s reasonable control, where the time period to release the CAMPERVAN vehicle may be extended. Under circumstances where the CAMPERVAN vehicle is returned late by a previous hirer, MAC will contact the HIRER as soon as that information is known, and advise the HIRER of the estimated revised date and time of collection, which may be outside the standard time of collection. Where the CAMPERVAN vehicle is still expected to be able to be collected by the HIRER on the same date but at a time outside the standard collection time, the HIRER will be given the option of either collecting at that revised time of collection, or to collect on the next day at the standard collection time. In either circumstances, MAC will apply a pro-rata refund of the average daily RENTAL CHARGE calculated between the number of hours elapsed between the time of the latest planned collection time and the actual time of release of the CAMPERVAN vehicle to the HIRER. Under exceptional circumstances where: • the CAMPERVAN vehicle is returned damaged by a previous hirer and is deemed unsuitable by MAC for immediate re-hire, MAC will contact the HIRER as soon as that information is known and where there is availability, offer an equivalent REPLACEMENT VEHICLE; or • alternatively, where there is no REPLACEMENT VEHICLE available, MAC will terminate the BOOKING and refund the HIRER in full for all RENTAL CHARGES paid to date. No other compensation will be due to the HIRER. MAC reserve the right to cancel a BOOKING either at any time before the HIRE PERIOD or on the date of collection, for any of the following circumstances: (a) where none of the proposed DRIVER(S) can satisfy the insurance documentation requirements as set out in these Terms and Conditions and/or pay the INSURANCE LOADING CHARGES and/or where MAC’s insurer declines at their absolute discretion to offer insurance; (b) where the HIRER either fails or refuses to provide the SECURITY DEPOSIT; (c) where any declaration, statement, representation or warranty made by the HIRER in respect to him/herself or any additional DRIVER(S) is found to be incorrect; (d) where it is discovered that the HIRER entered into the BOOKING or the RENTAL AGREEMENT through fraud or misrepresentation; (e) where MAC considers on reasonable grounds that the safety of the HIRER’s party, other road users and pedestrians, or the CAMPERVAN vehicle is in danger. In the event of any of the above circumstances, the BOOKING will be cancelled and the HIRER’s rights to any refund are as detailed at Section 14(c). No other compensation will be due to the HIRER. MAC reserve the right to terminate the hire of the CAMPERVAN vehicle to the HIRER during the HIRE PERIOD, for any of the following circumstances: (f) where MAC believes or discovers that the HIRER is in breach of any of these Terms and Conditions (including any insurance requirements), the BOOKING or the RENTAL AGREEMENT; (g) where the CAMPERVAN vehicle appears to be have been abandoned, lost (through theft) or damaged in an incident or accident by the HIRER; (h) where the CAMPERVAN vehicle is not returned at the allotted date and time of return (and no advice of such a late return has been notified to MAC by the HIRER), or where MAC reasonably believes that the CAMPERVAN vehicle will not be returned at the allotted date and time of return; (i) where any declaration, statement, representation or warranty made by the HIRER in respect to him/herself or any additional DRIVER(S) is found to be incorrect; (j) where it is discovered that the HIRER entered into the BOOKING or the RENTAL AGREEMENT through fraud or misrepresentation; (k) where MAC considers on reasonable grounds that the safety of the HIRER’s party, other road users and pedestrians, or the CAMPERVAN vehicle is in danger. In the event of any of the above circumstances, then: • the hire of the CAMPERVAN vehicle will be terminated with immediate effect; • measures will be taken by MAC to repossess the CAMPERVAN vehicle as soon as possible; • the HIRER has no right to any refund for the shortened HIRE PERIOD caused by such a termination, nor for compensation for any alternative travel, accommodation or any other arrangements that the HIRER may need to make; • the HIRER’s responsibilities for all matters in respect of these Terms and Conditions remain intact and do not expire, and MAC will pursue any resultant costs and damages owed by the HIRER initially through the SECURITY DEPOSIT funds, with any residual outstanding amounts being chased as a debt of the HIRER to MAC. MAC reserve the right to terminate the hire of the CAMPERVAN vehicle to the HIRER before the date and time of collection, where operational issues affecting the CAMPERVAN vehicle are beyond the reasonable control of MAC and cannot be readily fixed or remedied. MAC will contact the HIRER as soon as that information is known and where there is availability, offer an equivalent REPLACEMENT VEHICLE. Where MAC cannot offer the HIRER a REPLACEMENT VEHICLE, MAC will terminate the BOOKING and refund the HIRER in full for all RENTAL CHARGES paid to date. No other compensation will be due to the HIRER. 14. CANCELLATION OF HIRE BY THE HIRER In the event of a cancellation of the hire of the CAMPERVAN vehicle by the HIRER the following refunds of the RENTAL CHARGE will be due: (a) forty-two (42) days or more prior to the allotted date of collection: the DEPOSIT FEE; (b) between forty-one (41) and twenty-one (21) days prior to the allotted date of collection: 50% of the RENTAL CHARGE; (c) twenty (20) days or less of the allotted date of collection (including a ‘no show’): 100% of the RENTAL CHARGE. MAC will process the applicable refund to the HIRER, less a £10.00 administration fee, by direct bank transfer to the HIRER within seven (7) days of the HIRER’s notification of wishing to cancel the hire of the CAMPERVAN vehicle. Such notifications shall only be via telephone and then confirmed by the HIRER in an email. All HIRER’s are advised to check their own travel insurance policy coverage in the event of a cancellation by the HIRER. 15. RIGHT TO CHANGE OF VEHICLE MAC will make every effort to have the CAMPERVAN ready for collection at the date and time confirmed in the BOOKING and the RENTAL AGREEMENT. However: • where, for operational reasons beyond the reasonable control of MAC; or • where a previous hirer is late in returning a CAMPERVAN vehicle; or • where the CAMPERVAN vehicle is returned damaged by a previous hirer and is deemed unsuitable by MAC for immediate re-hire, MAC will contact the HIRER as soon as that information is known and where there is availability, offer an equivalent REPLACEMENT VEHICLE. No changes will be made to the RENTAL CHARGES due from the HIRER and no other compensation will be due to the HIRER. Alternatively, where there is no REPLACEMENT VEHICLE available, MAC will terminate the BOOKING and refund the HIRER in full for all RENTAL CHARGES paid to date. No other compensation will be due to the HIRER. 16. VEHICLE HANDOVER AT COLLECTION ________________________________________ MAC will make every effort to have the CAMPERVAN ready for collection at the allotted date and time confirmed in the BOOKING and the RENTAL AGREEMENT. However, during busy periods there may be time delays which are outside of MAC’s reasonable control, where the time period to release the CAMPERVAN vehicle may be extended. MAC pride themselves on ensuring that the CAMPERVAN vehicle is clean and that all operational features are in a safe and working order, and ready for the HIRER at the date and time of collection. MAC’s pre-hire checks and inspections involves testing every system on board the CAMPERVAN to ensure they are operating safely and correctly. At collection, MAC will demonstrate the use and operation of all of the features of the CAMPERVAN vehicle (including any on-board security systems) and any EXTRA EQUIPMENT to the HIRER. The HIRER should allow one (1) hour to complete all insurance documentation checks, the ‘Pre-Handover Checklist’ and demonstration of use and operation of the CAMPERVAN vehicle. Should an onboard system or features of the CAMPERVAN vehicle fail during the HIRE PERIOD, the HIRER is welcome to make telephone contact with MAC during the hours of 09:00 and 18:00, to see if MAC can assist the HIRER in remedying the fault but in some circumstances this may not be possible. Where any fault to any onboard system or non-base chassis elements and features of the CAMPERVAN vehicle is deemed by either MAC or the HIRER to be a safety issue that may affect the integrity of the CAMPERVAN vehicle or the personal safety of the HIRER and any of his/her party, MAC may request that the HIRER takes the CAMPERVAN vehicle to a recognised motor vehicle outlet for them to carry out a preliminary investigation into the fault and/or to temporarily isolate and make safe the element believed to be at fault. Where an authorised person from the outlet believes that it is unsafe for the HIRER and his/her party to continue to drive or inhabit the CAMPERVAN vehicle, then the HIRER must ensure that the following procedures are followed: (a) smartphone photographic and/or video evidence of the fault must be taken and shared with MAC; (b) written evidence of the opinion of the outlet authorised person must be obtained and shared with MAC; and (c) with MAC’s prior agreement and reference to the documentation included in the CAMPERVAN vehicle of the RAC breakdown and roadside assistance service, the coverage provides for the safe recovery of the CAMPERVAN vehicle to an authorised garage; a contribution to alternative travel or emergency overnight accommodation for the HIRER and his/her party, plus cover if any sole DRIVER is medically unfit to drive. MAC will not be held responsible to the HIRER (and to any members of his/her party) for any costs, losses or damages incurred in the event of the HIRER’s use of the CAMPERVAN vehicle being disrupted, stopped and/or re-started (after ay repairs) from any of the above circumstances, nor will the HIRER be entitled to the provision of a REPLACEMENT VEHICLE, nor any refund of the RENTAL CHARGES paid. In the event of any inclement or extreme weather conditions and/or during the case of any winter use of the CAMPERVAN vehicle, any damage to or loss of use of the CAMPERVAN vehicle during the HIRE PERIOD are at the HIRER’s exclusive risk and liability. ________________________________________ 17. PERMITTED USES OF THE VEHICLE ________________________________________ During the entire HIRE PERIOD, the HIRER unequivocally agrees that the CAMPERVAN vehicle will not be: (a) driven by persons other than a DRIVER; (b) driven by any DRIVER(S) whilst under the influence of alcohol and/or drugs (whether prescribed or not), and/or with a blood alcohol level in excess of that permitted by the law of the country that the CAMPERVAN vehicle is being driven in; (c) allow any smoking in or around the CAMPERVAN vehicle (this includes e-cigarettes and vapes); (d) used to carry people, equipment or goods for hire or reward; (e) used to carry more people (including children) than the maximum number of persons that the CAMPERVAN vehicle can carry, as stated in the BOOKING and the RENTAL AGREEMENT; (f) used to carry dangerous goods or materials (volatile liquids, gases, explosives, corrosive or inflammable materials), not supplied by MAC as standard and safe equipment with the CAMPERVAN vehicle; (g) used for any illegal purpose; (h) used for any race or rally event or contest; (i) used to tow any other twin-axle motor vehicle (any Driver is permitted to tow a trailer transporting anything other than another twin-axle motor vehicle, provided such use is declared at the time of BOOKING and confirmed as agreed within the BOOKING and the RENTAL AGREEMENT, where only third-party insurance coverage applies); (j) driven other than in a legal, normal, cautious and prudent manner, and/or in a manner which could cause mechanical breakdown and/or damage to the CAMPERVAN vehicle, and/or physical harm to the people and any pets in the CAMPERVAN vehicle, and/or to any other road users and their vehicles, and to any other persons not in the HIRER’S party, and to any other property or physical assets; (k) driven with due regard to any height, weight and width restrictions of the route chosen; (l) driven off-road (with the exception of private and made-up tracks intended for use by twin-axle motor vehicles); (m) driven in inclement or adverse weather conditions, where damage to the CAMPERVAN vehicle may occur; (n) driven in a prohibited area, and/or in circumstances where damage to the CAMPERVAN vehicle may occur through water submersion and/or any contact with saltwater and/or any natural or man-made watercourse; (o) driven outside the geographical limits of the UK, unless such use is otherwise permitted as stated in the BOOKING and the RENTAL AGREEMENT; (p) to be parked-up in a manner which may cause damage to the CAMPERVAN vehicle by the accidental and/or intended actions and/or negligence of the HIRER and his/her party, by other persons not in the HIRER’S party or by any other property or physical assets (e.g. trees and other natural features); and/or (q) otherwise used in breach of any other HIRER obligations under these Terms and Conditions, the BOOKING and/or the RENTAL AGREEMENT. Throughout the HIRE PERIOD, the HIRER shall further ensure that whilst the CAMPERVAN vehicle is unoccupied, that the CAMPERVAN vehicle is locked-up and made secure (including the use of any supplied CAMPERVAN vehicle security devices), that any internal equipment and/or valuables are stored away / out of view, and that no CAMPERVAN vehicle keys etc., are left in the CAMPERVAN vehicle. 18. PETS: MAC welcome either: • one (1) large dog; or • two (2) small dogs, which are well behaved and not deemed as aggressive, in the CAMPERVAN vehicle during the HIRE PERIOD, where agreed with MAC and where an additional premium has been included in the BOOKING and the RENTAL AGREEMENT. HIRER’s are requested to check with MAC at the time of the BOOKING to confirm details and whether dogs can be accommodated. HIRER’s are requested to secure their dogs whilst the CAMPERVAN vehicle is being driven, ensure that any dog(s) cause no damage and that any dog is kept off the chairs and bed. ________________________________________ 19. GENERAL CAMPERVAN BASE VEHICLE MAINTENANCE MAC pride themselves on ensuring that the CAMPERVAN vehicle has been maintained and kept in good working order, serviced and checked over on a per hire basis, and ready for the HIRER at the date and time of collection. During the HIRE PERIOD, it will be the HIRER’S responsibility to take all standard and reasonable steps to properly check and maintain the CAMPERVAN vehicle by checking tyres and their pressures, oil and coolant levels, and the vehicle / leisure batteries. As a first course of action in the event of any mechanical fault with the base chassis of the CAMPERVAN vehicle, the HIRER is required to make use of the complimentary RAC breakdown and roadside assistance service, to check for any mechanical vehicle faults and details of this service can be found in the documentation as provided with the CAMPERVAN vehicle. The RAC breakdown and roadside assistance service will not cover any assistance with faults that occur to the non-base chassis (namely the internal fittings and features of the cooking, living and sleeping areas) of the CAMPERVAN vehicle. Where the RAC personnel can confirm that the mechanical fault to the CAMPERVAN vehicle base chassis is not deemed to be a HIRER or DRIVER fault, MAC will reimburse the HIRER up to a VAT-inclusive limit of £100.00 for the reasonable cost of rectifying such faults at a recognised motor vehicle repair outlet, provided that a valid VAT receipt is handed to MAC at the date of return, which details the CAMPERVAN vehicle registration number, the date and description of the rectification works undertaken by the garage, and a fully itemised cost breakdown. Where the motor vehicle repair outlet confirms that the cost of rectifying such faults would cost in excess of £100.00 (incl. VAT), the HIRER must request that the outlet telephone MAC with details of the fault for pre-authorisation of any rectification works. Any rectification works exceeding the £100.00 limit without pre-authorisation from MAC, will result in MAC only reimbursing the HIRER for £50.00 and only on production of the receipt. The HIRER will be liable for any costs associated with the call-out and rectifying any defect deemed to be HIRER or DRIVER error / fault, where such costs may be charged to MAC (examples include works to remedy the incorrect re-fuelling of the CAMPERVAN vehicle and a flat battery etc.). These costs will be the responsibility of the HIRER and deducted from the SECURITY DEPOSIT. All MAC CAMPERVAN vehicles run on diesel. 20. RAC BREAKDOWN AND ROADSIDE ASSISTANCE SERVICE IN THE UK MAC provide a complimentary 24-hour RAC breakdown and roadside assistance service for the HIRER’s peace of mind. Details of the service, including the telephone number to call to activate and call out the RAC breakdown and roadside assistance service is provided with the documentation provided in the CAMPERVAN vehicle, which also includes: • for the safe recovery of the CAMPERVAN vehicle to a local authorised garage; and/or • a contribution to alternative travel or emergency overnight accommodation for the HIRER and his/her party, plus cover if any sole DRIVER is medically unfit to drive.. 21. BREAKDOWN AND ROADSIDE ASSISTANCE SERVICE OUTSIDE OF THE UK Where MAC agree and the BOOKING and the RENTAL AGREEMENT confirm that the HIRER is permitted to use the CAMPERVAN vehicle outside of the geographic limits of the UK, MAC can also arrange for breakdown and roadside assistance service outside of the UK to be provided at an additional cost which will be confirmed by MAC at the time of the BOOKING. MAC provide the strict condition that where repairs are required under such non-UK breakdown and roadside assistance cover, that the HIRER must receive email authority from MAC before instructing any recovery and/or repairs to the CAMPERVAN vehicle. The non-UK breakdown and roadside assistance cover also provides coverage for onward travel of the HIRER and his/her party, and recovering the CAMPERVAN vehicle back to the MAC Depot. The previous provisions of excluded matters that are set out in Section 19.0 also apply. 22. RESPONSIBILITY WHEN AN ACCIDENT OCCURS ________________________________________ In the event of any incident, accident, loss or damage arising out of the use of the CAMPERVAN vehicle including damage to a third-party vehicle, property and/or other assets, the HIRER is required to: • to immediately report the incident / accident to the police and any other relevant emergency agencies, and to cooperate fully with their line of enquiries; • where the event occurs between 0900 and 1800 hours UK time, to notify MAC by telephone and email within three (3) hours of the occurrence of the event; • where the event occurs outside the above hours, to notify MAC by telephone and email by 10am UK time on the next day; • complete the incident / accident form as supplied by MAC, which needs to include the date, time, location and details of the incident / accident, with names and addresses of third parties and any witnesses; • also take and share with MAC, smartphone photographic and/or video evidence of the incident / accident; • to full assist MAC and MAC’s insurers’ in the case management of any claim arising from the event. The HIRER also acknowledges that the STANDARD INSURANCE EXCESS and/or any other amount due in respect of any damage arising from an incident, accident, loss or damage is payable at the time of reporting the event and not at the completion of the HIRE PERIOD, regardless of which party is at fault. The HIRER also accepts that no SECURITY DEPOSIT, the STANDARD INSURANCE EXCESS and/or any other amount retained will be refunded until the claim is settled by MAC’s insurers. ________________________________________ 23. TRAFFIC FINES / VIOLATIONS / TOLLS / CONGESTION CHARGES ________________________________________ DRIVER(S) are personally liable for all legal penalties, fines and fees pertaining to any traffic violation infringements under all current road traffic legislation applicable in the UK and any non-UK countries holding a reciprocal recovery arrangement with the UK, arising from the HIRER’S use of the CAMPERVAN vehicle during the HIRE PERIOD. The HIRER is personally liable for any parking fines, tolls, congestion and other penalty charges that may arise from the HIRER’S use of the CAMPERVAN vehicle during the HIRE PERIOD. It is not uncommon for these penalties, fines and fees to be notified to MAC many weeks after the end of the HIRE PERIOD. On receipt of such notifications, MAC will forward the HIRER’S name and address contact details onto the agency chasing and/or imposing such penalties, fines and fees, and will also advise the HIRER of their actions and take payment from the HIRER of a £25.00 administration fee per penalty, fine or fee notification. It will be the responsibility of the HIRER to identify which DRIVER is responsible for the payment of any specific penalties, fines and fees. ________________________________________ 24. AGREEMENT BETWEEN THE HIRER AND MAC ________________________________________ The RENTAL AGREEMENT, when read with the BOOKING and these Terms and Conditions, is entire agreement between the HIRER and MAC for the hire of the CAMPERVAN vehicle during the HIRE PERIOD. Unless there is express provision within these Terms and Conditions, or there is a statutory right, then MAC shall take no responsibility for any delay, loss, damage or injury that the HIRER may experience in connection with the hire of the CAMPERVAN vehicle during the HIRE PERIOD, no matter how such delay, loss, damage or injury is caused, and/or by whom. MAC shall provide no refunds where the HIRER seeks to change, cancel and/or vary the BOOKING and RENTAL AGREEMENT, after the collection of the CAMPERVAN vehicle. These Terms and Conditions, nor the BOOKING, nor the RENTAL AGREEMENT cannot be varied, altered and/or waived by any non-director employee or representative of MAC. Any authorised statements or decisions from MAC, can only be deemed to be valid and authorised, where such statements or decisions are confirmed in writing by a director of MAC. ________________________________________ 25. COMPLAINTS ________________________________________ Where the HIRER is dissatisfied with any aspect of the customer service and/or use of the CAMPERVAN vehicle as provided by MAC during the HIRE PERIOD, the HIRER should formalise their complaint in writing and issue it to the ‘Customer Services Director’ at MAC, at the registered business address as set out in their website. MAC aim to respond to the HIRER within ten (10) working days. If the HIRER is not satisfied with how any complaint has been responded to, the HIRER is requested to correspond with the ‘Managing Director’ of MAC within a further ten (10) working days, following which telephone contact will be made with the HIRER to resolve the complaint.
